1. Acceptance of Terms
By accessing or using the JobSeek platform at jobseek.nz and any associated mobile applications, APIs, or services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy.
If you do not agree to these Terms, you must not access or use the Platform.
If you are using the Platform on behalf of a business or organisation, you represent and warrant that you have authority to bind that entity to these Terms, and references to "you" shall include that entity.
2. Definitions
- "Platform" means the JobSeek website, mobile applications, APIs, and all related services operated by JobSeek New Zealand Limited.
- "JobSeek", "we", "us", or "our" means JobSeek New Zealand Limited, a company incorporated in New Zealand.
- "User" means any person who accesses or uses the Platform, including Candidates, Employers, and Recruiters.
- "Candidate" means an individual who uses the Platform to seek employment opportunities.
- "Employer" means a company or individual who uses the Platform to post jobs and hire candidates.
- "Recruiter" means a recruitment agency or individual recruiter who uses the Platform's CRM and agency tools.
- "Content" means all text, data, images, documents, and other material submitted to, stored on, or generated by the Platform.
- "Verification Services" means the identity, work rights, licence, qualification, and criminal record verification features of the Platform.
- "JobSeek Passport™" means the candidate trust score and verification badge system operated by JobSeek.
- "Subscription" means a paid plan giving access to certain Platform features.
3. Eligibility
To use the Platform you must:
- Be at least 16 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Platform under any applicable law
- Not have had a previous account suspended or terminated by JobSeek for breach of these Terms
Employers and Recruiters must additionally:
- Be a legitimately operating business or individual with lawful authority to hire
- Provide accurate company information including NZBN where requested
- Use the Platform only to fill genuine employment vacancies
4. Accounts and Registration
4.1 Account Creation
You must create an account to access most Platform features. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:
- Choose a strong password of at least 12 characters
- Enable multi-factor authentication (strongly recommended)
- Not share your login credentials with any other person
- Notify us immediately at security@jobseek.nz if you suspect unauthorised access to your account
4.3 One Account Per Person
Each individual may hold only one Candidate account. Creating multiple accounts for the same person is prohibited and may result in suspension of all associated accounts.
4.4 Account Verification
We reserve the right to verify the identity of any user and to require additional verification before granting access to certain features. Employer accounts are subject to review before activation.
5. Candidate Terms
5.1 Profile Accuracy
You must ensure that all information in your candidate profile is truthful, accurate, and not misleading. You must not misrepresent your qualifications, experience, work rights, or any other information relevant to your employment eligibility.
Providing false information, including claiming qualifications you do not hold, misrepresenting your right to work in New Zealand, or submitting fraudulent identity documents, is a serious breach of these Terms and may constitute a criminal offence.
5.2 Work Rights
You are solely responsible for ensuring you hold and maintain the necessary work rights for any position you apply for. JobSeek's verification services assist employers in checking work rights but do not constitute legal advice or a guarantee of employability.
5.3 Job Applications
By submitting a job application through the Platform, you consent to the employer or recruiter responsible for that vacancy accessing your profile, CV, and supporting documents as disclosed on the application.
You must only apply for positions you genuinely intend to pursue. Mass, automated, or spam applications are prohibited.
5.4 Verification Consent
All verification checks (identity, criminal record, work rights, driver licence, qualifications) require your explicit consent before they are initiated. You may withdraw consent for future checks but cannot retroactively revoke a check that has already been completed.
5.5 JobSeek Passport™
The JobSeek Passport™ Trust Score is an automated calculation based on your verification completeness. It does not constitute a reference, employment recommendation, or guarantee of character. JobSeek makes no warranties regarding the accuracy of the Trust Score for any particular employment purpose.
5.6 Onboarding Data
Payroll information (IRD number, bank account, tax code) collected during onboarding is provided voluntarily and shared only with the specific employer for the purpose of payroll setup. You are responsible for ensuring the accuracy of this information.
6. Employer Terms
6.1 Legitimate Use
The Platform may only be used to fill genuine employment vacancies. You must not post jobs that do not exist, collect candidate data for any purpose other than legitimate hiring, or use the Platform for competitor intelligence or data harvesting.
6.2 Job Posting Accuracy
All job postings must accurately reflect the role being offered. You must not post misleading salary ranges, fabricate company details, or omit material requirements. Job postings must comply with all applicable New Zealand employment, human rights, and advertising law.
6.3 Non-Discrimination
You must not use the Platform in any way that discriminates against candidates on the basis of sex, gender, race, ethnicity, religion, age, disability, sexual orientation, marital status, pregnancy, or any other ground protected by the Human Rights Act 1993 or the Employment Relations Act 2000.
Screening questions and knockout rules must relate only to genuine occupational requirements.
6.4 Candidate Data Handling
By accessing candidate information through the Platform, you become a separate data controller of that information under the Privacy Act 2020. You must:
- Use candidate information only for the recruitment purpose for which it was provided
- Not share candidate information with third parties without the candidate's consent
- Handle verification status information with appropriate confidentiality
- Delete candidate information when it is no longer required for the recruitment process
- Comply with all obligations of the Privacy Act 2020 in relation to that information
6.5 Offers and Onboarding
Offer letters and employment documents created through the Platform are your legal documents. JobSeek provides templates and tools as a convenience but does not provide legal advice. You are responsible for ensuring your employment agreements comply with the Employment Relations Act 2000 and all applicable employment law.
6.6 Subscription and Job Credits
Access to certain employer features requires a paid subscription. Job credits, where applicable, are non-transferable and expire as stated at the time of purchase. Unused credits are not refundable.
6.7 NZBN Verification
By providing your NZBN during registration, you authorise us to verify your company details against the New Zealand Business Register. You warrant that you are authorised to register the company on the Platform.
7. Recruiter Terms
7.1 Agency Obligations
Recruitment agencies and individual recruiters using the Platform's agency tools must comply with all applicable New Zealand law governing recruitment activities, including obligations under the Employment Relations Act 2000 and the Fair Trading Act 1986.
7.2 Candidate Consent
Before submitting a candidate to an employer through the Platform, you must have obtained the candidate's explicit consent to that submission. You must not submit a candidate to multiple employers simultaneously without the candidate's knowledge.
7.3 Fee Transparency
Placement fees and billing arrangements are between you and your employer clients. JobSeek is not a party to any placement fee agreement and accepts no liability for non-payment of fees.
7.4 Client Data
Client contact information stored in the Recruiter CRM must be held lawfully. You are responsible for ensuring you have appropriate grounds to hold and process client data under the Privacy Act 2020.
7.5 Agency Subscription
The Recruiter CRM and agency features are available under a monthly subscription. The subscription covers one agency. Individual recruiter seats are as specified in your plan. Exceeding your plan limits may result in access restrictions or additional charges.
8. Verification Services
8.1 Nature of Verification
JobSeek's Verification Services provide an indication of a candidate's verification status at the time the check was performed. A verification badge does not guarantee the ongoing accuracy of the underlying information and is not a warranty of character, suitability for employment, or fitness for any particular role.
8.2 Employer Reliance
Employers and recruiters must not rely solely on JobSeek verification results when making employment decisions. You remain responsible for conducting your own due diligence as required by law, including checking work rights directly where required.
8.3 Verification Expiry
Verification results expire as specified on the Platform. An expired verification badge should not be treated as current. You are responsible for monitoring expiry dates for candidates in your employment.
8.4 Third-Party Providers
Some verification services are conducted by third-party providers (NZTA, Ministry of Justice, Immigration NZ, RealMe). JobSeek does not control and cannot guarantee the accuracy, availability, or timeliness of results from third-party providers.
8.5 Criminal Record Checks
Criminal record check results are disclosed to employers only as a status (e.g., "check completed"). Full criminal history is not disclosed through the Platform. Employers must handle any criminal history information in accordance with the Criminal Records (Clean Slate) Act 2004 and the Privacy Act 2020.
9. Digital Signatures
9.1 Legal Effect
Digital signatures created through the Platform are intended to have the same legal effect as handwritten signatures under the Contract and Commercial Law Act 2017. By typing your name and clicking accept on a document, you agree that this constitutes your binding digital signature.
9.2 Verification
Each signed document includes a SHA-256 verification seed derived from the signing metadata. This seed may be used to independently verify that the signature record has not been altered after signing.
9.3 Responsibility
You are responsible for reviewing the full contents of any document before signing. You must not sign a document unless you have read and understood it and genuinely agree to its terms. JobSeek is not a party to the employment agreement or other document being signed and accepts no liability for its contents.
9.4 Retention
Signed documents and their audit trails are retained in accordance with our Privacy Policy and applicable law. You may access your signed documents through your onboarding vault at any time during the retention period.
10. AI Services
10.1 Nature of AI Features
The Platform uses artificial intelligence to provide features including CV parsing, job matching, candidate ranking, job description generation, salary recommendations, and the JobSeek Copilot™ assistant. These are tools to assist human decision-making, not replacements for it.
10.2 AI Accuracy
AI-generated content, match scores, and recommendations may contain errors or inaccuracies. JobSeek makes no warranty that AI outputs are accurate, complete, or suitable for any particular purpose. You must exercise your own judgement when acting on AI outputs.
10.3 No AI Employment Decisions
Automated systems on the Platform do not make final employment decisions. All hiring decisions remain with human employers and recruiters. Knockout questions and automatic rejections are tools that employers configure — the employer, not JobSeek, is responsible for the lawfulness of any screening criteria.
10.4 AI Content Ownership
AI-generated job descriptions, emails, and other content generated using the Platform's tools belong to you once generated and edited by you. You are responsible for reviewing and taking ownership of any AI-generated content before publishing or sending it.
11. User Content
11.1 Your Content
You retain ownership of all content you submit to the Platform (your CV, profile information, job postings, messages, notes, and documents). By submitting content, you grant JobSeek a non-exclusive, royalty-free, worldwide licence to store, process, display, and transmit that content as necessary to operate the Platform and provide the services you have requested.
11.2 Content Standards
All content submitted to the Platform must:
- Be truthful and not misleading
- Not infringe any third party's intellectual property rights
- Not contain offensive, discriminatory, defamatory, or unlawful material
- Not include malware, viruses, or harmful code
- Comply with all applicable New Zealand law
11.3 Content Moderation
We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful, misleading, or inappropriate. We will endeavour to notify you of any removed content but are not obligated to do so.
11.4 Feedback
If you provide feedback, suggestions, or ideas about the Platform, you grant JobSeek the right to use that feedback without restriction or compensation to you.
12. Payments and Billing
12.1 Fees
Certain features of the Platform require payment. All fees are stated in New Zealand Dollars (NZD) and are inclusive of GST unless otherwise stated. Current pricing is available at jobseek.nz/pricing.
12.2 Payment Processing
Payments are processed by our authorised payment processor. We do not store credit card or payment account details on our systems. By making a payment, you agree to the payment processor's terms.
12.3 Subscriptions
Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access until that date.
12.4 Refunds
We do not offer refunds for subscription fees already paid unless required by the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Job posting credits that have not been used are not refundable unless the service has not been provided due to a fault on our part.
12.5 Price Changes
We may change our pricing at any time. For existing subscribers, price changes take effect at the next renewal date following 30 days' notice. If you do not accept the new price, you may cancel before the next renewal date.
12.6 Failed Payments
If a payment fails, we will attempt to notify you and retry the payment. Continued failure may result in suspension of your account until payment is received. You remain liable for any outstanding amounts.
13. Prohibited Conduct
You must not, and must not attempt to:
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
- Submit false, misleading, or fraudulent information of any kind
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Create multiple accounts to circumvent account suspensions or restrictions
- Use automated tools, scripts, bots, or scrapers to access, extract, or interact with the Platform without our express written permission
- Attempt to gain unauthorised access to any part of the Platform, user accounts, or our systems
- Interfere with or disrupt the Platform's security, integrity, or availability
- Harvest, collect, or compile personal information about other users without their knowledge and consent
- Use the Platform to send spam, unsolicited commercial messages, or bulk communications
- Post job advertisements that do not relate to genuine employment vacancies
- Use the Platform to facilitate or promote illegal employment practices
- Circumvent any access controls, geolocation restrictions, or verification requirements
- Reverse engineer, decompile, or attempt to extract the source code of the Platform
- Use the Platform's data to train AI models or build competing services without our written consent
- Engage in any activity that imposes an unreasonable or disproportionate load on our infrastructure
14. Intellectual Property
14.1 JobSeek IP
The Platform, including all software, design, text, graphics, logos, and the JobSeek Passport™ and JobSeek Copilot™ brands, is owned by or licensed to JobSeek and is protected by New Zealand and international intellectual property law.
Nothing in these Terms grants you any right, title, or interest in the Platform or its intellectual property other than the limited right to use the Platform in accordance with these Terms.
14.2 Your IP
You retain all intellectual property rights in content you submit to the Platform. The licence you grant us (section 11.1) does not transfer ownership of your content.
14.3 Feedback
Any feedback, suggestions, or ideas you provide regarding the Platform may be used by us without restriction and without compensation to you.
15. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
16. Third-Party Services
The Platform integrates with and links to third-party services including Microsoft, Google, NZTA, Immigration NZ, Xero, and OpenAI. These services are governed by their own terms and privacy policies. JobSeek is not responsible for the availability, accuracy, or practices of third-party services.
Your use of third-party services accessed through the Platform is at your own risk.
17. Disclaimers
To the maximum extent permitted by law, the Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Fitness for a particular purpose
- Merchantability
- Accuracy or completeness of content
- Uninterrupted or error-free operation
- The suitability of any candidate for any position
- The accuracy of AI-generated content or recommendations
- The outcome of any job application or recruitment process
JobSeek does not guarantee that the Platform will be free from bugs, viruses, or other harmful components, or that any defects will be corrected.
Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993 that cannot be excluded.
18. Limitation of Liability
To the maximum extent permitted by applicable law, JobSeek and its directors, employees, agents, and licensors are not liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunity
- Damages arising from your reliance on verification results, match scores, or AI outputs
- Damages arising from the conduct of employers, candidates, or recruiters using the Platform
- Loss arising from unauthorised access to your account due to your failure to maintain account security
- Loss arising from the unavailability, interruption, or termination of the Platform
Where liability cannot be excluded, our total liability to you for any claim arising from or in connection with these Terms or the Platform is limited to the greater of:
- NZD $500; or
- The total fees paid by you to JobSeek in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms limits JobSeek's liability for death, personal injury, or fraud, or any liability that cannot be limited by law.
19. Indemnity
You agree to indemnify, defend, and hold harmless JobSeek and its officers, directors, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Platform in breach of these Terms
- Any content you submit that infringes third-party rights
- Your breach of any applicable law
- Any misrepresentation made by you to JobSeek or to another user
20. Suspension and Termination
20.1 Termination by You
You may terminate your account at any time through your account settings or by contacting us at support@jobseek.nz. Upon termination, your access to the Platform will cease and your data will be handled in accordance with our Privacy Policy.
20.2 Suspension or Termination by JobSeek
We may suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have:
- Breached any provision of these Terms
- Provided false or misleading information
- Engaged in fraudulent activity
- Created a risk of legal liability for JobSeek or other users
- Been the subject of multiple verified complaints from other users
20.3 Effect of Termination
Upon termination: (a) your right to access the Platform immediately ceases; (b) we may delete your account and data subject to our retention obligations; (c) any outstanding fees remain payable; (d) provisions of these Terms that by their nature should survive termination (including sections 14, 17, 18, 19, and 21) will continue in full force.
21. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand. You submit to the exclusive jurisdiction of the New Zealand courts for resolution of any dispute arising from these Terms or your use of the Platform.
22. Dispute Resolution
We encourage you to contact us first if you have a complaint or dispute. Most issues can be resolved quickly and informally. Please contact us at support@jobseek.nz.
If we are unable to resolve a dispute informally within 20 working days, either party may refer the matter to mediation. If mediation is unsuccessful, the dispute may be referred to the New Zealand courts.
Nothing in this section prevents either party from seeking urgent injunctive or other interim relief from a court.
23. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and display a prominent notice on the Platform. The updated Terms will take effect 14 days after notification, or immediately for new users.
Continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the changes. If you do not accept the updated Terms, you must stop using the Platform and may terminate your account.
